The laws that govern the use of this impressive plant from Southeast Asia are changing. While there have been some attempts by the Drug Enforcement Administration (DEA) and Food and Drug Administration (FDA) to push for a Kratom legal ban. Nevertheless, there has been plenty of support for kratom use from the scientific community.
Is Kratom Legal In My State?
There are only 6 states in the USA that have listed Kratom as a controlled substance. In these states it is illegal to grow, possess, buy or sell this plant. Then there are some cities in legal states where the use of Kratom is also controlled and possession is banned.

In the State of Illinois kratom is legal for all over the age of 18 except one city that has listed it as controlled, Jerseyville.
Kratom is legal for those over the age of 18.
Legal everywhere except in the city of San Diego.
Kratom is legal for use and only banned in Sarasota County.
In Mississippi, Kratom is not controlled anywhere, but is banned in Union County.
Colorado is accepting of Kratom everywhere, except in Denver. The city that decriminalized psilocybin has made kratom “illegal for human consumption.”
Tennessee banned kratom in 2107 but soon the law was repealed making its use legal for those 21 and older.

Is Kratom Legal In My Country?
Because I am doing extensive research on the subject I have become somewhat of an authority on the legalities of Kratom use. Not every country in the world has precise information on kratom legal issues posted online so I am having to network with trustworthy sources from around the world to produce this information. I will be working to keep this information up to date as time goes by.
There is not much to say about kratom in Africa or whether it is legal. I have a coworker from South Africa working here at Kraken. She has told us that in South Africa most people have never even heard of this plant or its benefits.
So after looking a little further into the subject, I discovered that kratom is indeed legal in Spout Africa. As a matter of fact, South Africa has laws very simple to those in the US, inasmuch as no medical claims are established about the plant as yet. In the rest of Africa, the legality of kratom is mostly unclear.

Kratom is perfectly legal in Israel, Malaysia, Vietnam, Singapore, South Korea, Myanmar and Japan.
China’s laws are still a bit fuzzy in this regard, but Hong Kong, which is still a special legal system has made kratom legal.
Thailand has had a long history of legal kratom growth since 1943. All this is about to change though as Marijuana and Mitragyna speciosa (kratom) have been classified as Category 5 substances. This means there will be some big changes in the way these plants are regulated after Thai officials reexamine their potential. In 2018, the Narcotics Act of 1979 was updated and now both of these plants have been permitted for medical purposes although they are still Category 5 substances.
Australia & New Zealand
Australia has bans against all kinds of kratom use or possession. As a Schedule 1 substance in New Zealand, it is illegal to export and import, but may be obtained with the prescription of a local doctor.

In Canada, kratom has been made illegal for human consumption. So don’t attempt to bring any with you on your next visit.
From Mexico to Panama, there seems to be no restrictions of Kratom use.
I have found no laws against the use of kratom in the rest of South America. Although my research indicates it may be especially difficult to find in Brazil.
This 2019 we will see advocates beginning to take a stand for this beneficial herb. Still much of the country is still asking what is kratom? There will be a new congress as well as the beginning of many legislative sessions in different states. The laws that restrict kratom in your area could be loosened soon.
