If you regularly buy kratom online, you’ve probably noticed a lot of debate over kratom legality. The legal status of kratom depends on the outcome of a multi-year feud between passionate advocates of the Mitragyna Speciosa plant and powerful government agencies around the world, such as the US Food and Drug Administration (FDA).

Without more scientific research paired with bans across governments at the local and federal levels around the word, one might begin to wonder if legal kratom is a public health issue. It’s a valid concern, given how little information available online about kratom laws and Mitragyna Speciosa.

Kratom Legality Reasons

Health is at the center of the debate on whether kratom should become a banned substance. Rare kratom deaths are likely caused by a few factors we could speculate. Factors such as negligent kratom vendors not providing their customers with any useful information, harsh legal and financial consequences for suppliers providing that life-saving info, and customers having to rely on the internet for knowledge instead of their own Drug and Food Administration.

The laws that govern the use of this plant from Southeast Asia are changing. While there have been some attempts by the Drug Enforcement Administration (DEA) and Food and Drug Administration (FDA) to push for a US Kratom legal ban nationwide, it has yet to happen as of 2021. Nevertheless, there has been plenty of support for kratom use from the scientific community and well-respected individuals all over the world.

Is Kratom Legal In My State?

There are only 6 states in the USA that have listed Kratom as a controlled substance.  In these states it is illegal to grow, possess, buy or sell this plant. Then there are some cities in legal states where the use of Kratom is also controlled and possession is banned.

In the State of Illinois kratom is legal for all over the age of 18 except one city that has listed it as controlled, Jerseyville.

New Hampshire

Kratom is legal for those over the age of 18.


No California Kratom ban currently. Legal everywhere except in the city of San Diego.


Florida Kratom is legal for use and only banned in Sarasota County.


In Mississippi, Kratom is not controlled anywhere, but is banned in Union County.


Buy Kratom in Colorado legally everywhere, except in Denver. The city that decriminalized psilocybin has made kratom “illegal for human consumption.”

Is Kratom Legal In My Country?

Because I am doing extensive research on the subject I have become somewhat of an authority on the legalities of Kratom use. Not every country in the world has precise information on kratom legal issues posted online so I am having to network with trustworthy sources from around the world to discover the best places to buy kratom near me. There is not much to say about kratom in Africa or whether it is legal. I have a coworker from South Africa working here at Kraken. She has told us that in South Africa most people have never even heard of this plant or its benefits.

So after looking a little further into the subject, I discovered that kratom is indeed legal in Spout Africa. As a matter of fact, South Africa has laws very simple to those in the US, inasmuch as no medical claims are established about the plant as yet. Thailand has had a long history of legal kratom growth since 1943. All this is about to change though as Marijuana and Mitragyna speciosa (kratom) have been classified as Category 5 substances. This means there will be some big changes in the way these plants are regulated after Thai officials reexamine their potential. In 2018, the Narcotics Act of 1979 was updated and now both of these plants have been permitted for medical purposes although they are still Category 5 substances.

Australia & New Zealand

Australia has bans against all kinds of kratom use or possession. As a Schedule 1 substance in New Zealand, it is illegal to export and import, but may be obtained with the prescription of a local doctor.

North America

The United States has already been covered, above.

In Canada, kratom has been made illegal for human consumption. So don’t attempt to bring any with you on your next visit.

From Mexico to Panama, there seems to be no restrictions of Kratom use.

South America

I have found no laws against the use of kratom in the rest of South America. Although my research indicates it may be especially difficult to find in Brazil.

This 2021 we will see advocates beginning to take a stand for this beneficial herb. Still much of the country is still asking what is kratom? There will be a new congress as well as the beginning of many legislative sessions in different states. The laws that restrict kratom in your area could be loosened soon.
