Is Kratom illegal to buy in Vermont? The Green Mountain State is known for fall foliage and and a very unique and open New England culture that is quite different from anywhere else in the country. While a proud history of independence is shared among many of the people here, unfortunately when it comes to kratom and kratom use, that currently as of this writing doesn’t apply.
Is Kratom Legal in Vermont?
Vermont is one of the few states where kratom is illegal to buy, sell, carry, or use. Kratom is considered a controlled substance in the state of Vermont. That means that specifically under state law it is not legal to use, to buy, or to sell. The punishment would potentially be the same as other illegal drugs of similar amounts or weight.
So if you live in Vermont or are going to be visiting there, best to leave the kratom at home and just pick up some new when you’re in a more friendly state. Kratom vendors will not send or sell to the state of Vermont and it is illegal to buy, sell, or use.
Why is Kratom Illegal in Vermont?
The reason for this is because of two specific compounds found in kratom that were labeled as active alkaloids are considered controlled substances. This is because they are found in some other things that can more easily be considered drugs. The argument that those compounds don’t have the same effect on kratom, and that kratom is closer to coffee than it is to a controlled substance.
The end result? In the state of Vermont kratom is not legal.
Kratom itself wasn’t made illegal by Vermont which is where the confusion came from. The guilty factions here are the two active components that make kratom a viable medicinal treatment: Mitragynine and 7-hydroxymitragynine. These are actually the two substances that were specifically banned. Since kratom has both, kratom is therefore banned under the synthetic substances act under Vermont law.
Kratom wasn’t named specifically, which is why there was confusion for a long time. However, a name does not work as a legal technicality. Kratom has the two banned components and that means that unfortunately Kratom is not legal for sale or use in Vermont.
While some efforts where made by filling out petitions to the state capital, they were basically ignored and there is little sign that the government of Vermont has any intention or even any interest in changing these laws anytime soon. For now, Vermont is a no-go for kratom users.
