Is kratom legal in the state of North Carolina?
As of late 2019, the short answer is yes. Kratom is perfectly legal for any individuals aged 18 or older.
Two state senators had sponsored an October 2016 bill that would have included kratom on the controlled substances list. One of their motivations was that several medical examiners had discovered kratom in blood samples from 23 different opiate overdose victims.
A number of kratom supporters argued that the information was misleading. Many people use kratom to battle their opioid addictions, meaning that the presence of it was symptomatic, but not causation in terms of death.
Is Kratom Illegal in North Carolina?
In just 2017 alone, the National Institute for Drug Abuse had data indicating almost 50,000 fatalities related to opioid overdoes alone, with 70,000 more because of prescription drug overdose. At the same time, only 44 deaths are attributed to kratom by the Food and Drug Administration.
Kratom advocates launched numerous petitions to keep kratom in legal status within the state of North Carolina. Given that, the state legislature settled on an age restriction rather than a full ban.
Visitors and residents of North Carolina are allowed to buy and purchase kratom if they are over the age of 18. A number of smoke stores and vape shops carry it, although availability is inconsistent. The often gray areas regarding the legality of it scare many store owners away from carrying it.

The desire to ban kratom also happened at a federal level in 2016, as the DEA announced intentions to list it as a Schedule I substance that would have been banned across the country. Over 60 members of both houses of Congress noticed this, and they pleaded with the DEA to forgo the ban so a comment period could take place.
More than 23,000 comments were recorded, with a 99-percent favorable rating for kratom. Given this political climate, the DEA decided to back off and let the FDA handle it from then on.
